Oracle Issues Force Majeure Notice for New Mexico Stargate Data Center
Oracle has issued a force majeure notice to the developer behind Project Jupiter, a sprawling data center campus located in New Mexico. This notification, first reported by Bloomberg, appears to serve as a precaution rather than a signal that Oracle intends to withdraw as the primary tenant.
The concept of force majeure often appears in contracts related to energy and commodities and allows parties to delay their obligations when unforeseen circumstances arise. According to Bloomberg sources, Oracle is leveraging this clause to defer payments if the data center fails to meet its intended operational start date in 2028.
This notice comes amid heightened scrutiny of AI-focused data center constructions across the nation, as developers face escalating costs while accommodating major clients like OpenAI.
Despite the notice, Oracle reassures stakeholders that it does not foresee any delays. In a statement to CNBC, Oracle affirmed, “Project Jupiter remains on our planned schedule. We are fully committed to New Mexico and confident in our path forward.”
Blue Owl Capital, the unit receiving the force majeure notice, echoed this sentiment, stating that the notice will not alter the financial obligations tied to this multi-year endeavor.
Requests for further comments from both Oracle and Blue Owl had gone unanswered at the time of reporting.
However, this notice follows several setbacks associated with the project’s energy supply. The campus is designed to utilize 2.45 gigawatts of energy from gas-powered fuel cells supplied by Bloom Energy, making a steady gas supply crucial to its timeline.
An Energy Transfer pipeline meant to transport gas to the site has encountered delays of nearly six months and is now projected to be operational by February 1, 2027, due to repeated regulatory permit denials. In addition, an air-quality permit for the fuel cell system—essential for powering the campus—remains pending, with the state’s environmental department facing a deadline of November 23 to reach a decision.
Project Jupiter stands as a key component of the Stargate initiative—a collaborative AI infrastructure effort by Oracle, OpenAI, and SoftBank, which was announced during President Donald Trump’s second term. The project has met resistance from local residents and environmental advocates, becoming a politically charged topic as midterm elections approach. To address these concerns, Oracle has initiated a public outreach campaign aimed at garnering support from the community, according to Bloomberg.
Editor’s Take
The issuance of a force majeure notice by Oracle highlights the challenges facing large-scale AI data center projects amidst regulatory and infrastructure hurdles. This situation underscores the importance of stable energy supply chains and regulatory environments in tech ventures. Companies, developers, and stakeholders must closely monitor these developments, as they could impact timelines and investment decisions in the burgeoning AI infrastructure sector.
