Child Abuse Survivor Claims Elon Musk’s AI Chatbot Created Illegal Images Using Her Photos
A survivor of child sexual abuse has initiated a lawsuit against Elon Musk’s xAI, claiming that its AI chatbot, Grok, utilized images of her abuse to create new illegal pornographic content. The lawsuit accuses the company of generating child pornography that depicts the plaintiff and others similarly affected.
Filed in a California district court, the complaint asserts, “Using real images of Plaintiff and class members, Grok generated child pornography depicting Plaintiff and class members.” The plaintiff, identified as Jane Doe to preserve her anonymity, alleges that xAI not only generated exploitative images but also incorporated her existing abuse materials into its datasets following their public dissemination.
The lawsuit alleges a failure on xAI’s part to implement industry-standard protections against sexual abuse material, leading to the emergence of AI-generated child sexual abuse material (CSAM) on the platform X, formerly known as Twitter.
Despite Musk’s previous statements denying any knowledge of Grok creating “any naked underage images,” xAI has taken legal action against two users facing criminal charges related to such allegations. The company is pursuing these individuals for the financial repercussions of lawsuits filed by their victims.
This case uniquely contrasts with several other child sexual abuse-related litigations against xAI by claiming that the AI directly used pre-existing CSAM to produce and disseminate the illicit imagery. Earlier lawsuits, involving cases like a group of Tennessee teenagers, accused Grok of manipulating non-explicit photographs of minors to create harmful material, often by digitally stripping them of clothing.
The use of pre-existing CSAM is significant since law enforcement agencies often assign a digital fingerprint—referred to as a hash—to such illegal materials, allowing for their tracking across online platforms. Attorneys for the plaintiff stated that the Canadian Centre for Child Protection successfully identified the AI-generated CSAM on X by utilizing these fingerprints.
The plaintiff, who was a preschooler when subjected to repeated abuse and compelled to produce CSAM, has had her original materials circulated online for approximately two decades, which are widely known among authorities and child protection organizations.
Margaret Mabie, the plaintiff’s attorney, highlighted the crucial difference in this case, stating, “Here, because you can associate it with the series, we know that it is an identifiable victim who is still alive and was a real child in the photo.”
Neither xAI nor SpaceX, which acquired xAI in February, responded to media inquiries regarding this lawsuit. SpaceX’s valuation soared to around $1.7 trillion following an initial public offering earlier this year, elevating Musk to the rank of the world’s only trillionaire.
xAI is currently facing multiple lawsuits alleging the creation and distribution of child sexual abuse materials. Many complaints emerged early this year, during a period when lax safeguards allowed Grok to be directed to create sexualized images on command. Musk had previously stated that Grok’s not-safe-for-work mode aimed at enabling “upper body nudity of imaginary adult humans.” This functionality resulted in millions of sexualized images being generated rapidly, including thousands depicting minors.
While the recent class-action lawsuit focuses on its sole lead plaintiff, it notes the potential for “at least thousands of minors” experiencing similar harms. The ability of AI to generate child sexual abuse material signifies a new and troubling threat to the psychological wellbeing of victims, exposing them to recurrent trauma with every new AI-generated image.
“The fear now is that new criminal acts, new offensive behavior, new ideas of what can be done to them can now be created using AI. They can generate new abuse,” Mabie remarked, emphasizing the profound implications for survivors.
The Canadian Centre for Child Protection declined to comment on the ongoing litigation.
